1. About these terms

These Terms of Service apply to your use of mortive.com and to any purchase you make from Mortive ("we", "us", "our"). By using the website or placing an order, you agree to these terms and to our Refund Policy, Shipping Policy, Cancellation Policy and Privacy Policy, which form part of these terms.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order.

3. Our products

We try to show our products as accurately as possible, but colours can look different depending on your screen. Finishes described as yellow gold, white gold or rose gold describe the colour of a plated finish, not solid precious metal.

Size recommendations, including those from our size finder and size chart, are estimates based on the information you provide. Choosing the right size is your responsibility; if a bracelet does not fit, our Refund Policy explains how to return it.

Mortive is an independent brand. Our designs may draw on classic styles, but we are not affiliated with, endorsed by or sponsored by any other jewellery or watch maker.

4. Prices and promotions

All prices are shown in US dollars unless stated otherwise. Bundle prices apply automatically in your cart and only to the items and quantities shown in the offer. We may change prices and end promotions at any time, but changes will not affect orders we have already accepted.

If a product is listed at an incorrect price because of an error, we may cancel the order and refund you in full, even after it has been placed.

5. Orders and payment

Placing an order is an offer to buy. We may decline or cancel an order, for example if a product is unavailable, if we suspect fraud, or if the order appears to be for resale. If we cancel an order after payment, we will refund you in full.

By submitting payment details, you confirm that you are authorised to use that payment method and you authorise us to charge it for your order.

6. VIP Membership

The optional VIP Membership is a recurring monthly charge. Its price, billing and cancellation terms are set out in our Cancellation Policy.

7. Reviews and content you submit

If you send us reviews, photos or other content, you confirm that it is your own and accurate, and you give us permission to use it on our website and marketing. We may decline to publish content that is unlawful, offensive or unrelated to our products.

8. Intellectual property

All content on this website, including text, images, logos and design, belongs to Mortive or is used with permission. You may not copy or reuse it for commercial purposes without our written consent.

9. Acceptable use

You agree not to misuse the website, including by attempting to gain unauthorised access, interfering with its operation, or using it for any unlawful purpose.

10. Liability

To the extent permitted by law, we are not liable for indirect or consequential losses, and our total liability for any order is limited to the amount you paid for it. Nothing in these terms limits any rights you have under consumer protection laws that cannot be excluded.

11. Disputes

If you have a problem with an order, please contact us first at support@mortive.com. Most issues can be resolved quickly, and contacting us before opening a dispute with your bank helps us help you.

12. Governing law

These terms are governed by the laws of the place where Mortive is established, without regard to conflict of law rules. If you are a consumer, you also keep the protection of any mandatory laws of the country where you live.

13. Changes to these terms

We may update these terms from time to time. The version shown on this page when you place an order is the version that applies to that order.
